Does She Have a Case?

A young lady I had trained at a property called me as she would when she had questions on certain property issues; called to let me know that she was released from her position as manager.

She said that the owner’s son stayed at the property where she was employed and he was always asking her out on a date. She said she would smile and say she did not date her tenants as this would be a conflict of interest.

He moved out after about 12 months as he bought a house and asked her to come to the place and help him set up his house and she told him no. He told her that he was not a tenant and that there should not be a problem and she said well you are the son of the boss and I think it not right.

After this time she started having little issues with the owner and then she was let go. She told me that she thinks it was because of the son. I asked how come she did not bring this up when it first happened and she said that she did not want to cause problems.

I told her I was not a lawyer and that she needed to talk to a couple of lawyers to see if she had a case or not. Since the son was not employed by the father that it was maybe two issues. What do you think? How would you handle it?

She is best off speaking with a qualified attorney first. Any attorney in civil law can be found but she wants one who deals with labor issues/employment law. She needs to call Legal Aid and ask for a referral in her local area. They will give her names and she can get a small bit of free legal advice. Whether she wants to pursue or not depends on the advice she gets. She may not be able to afford to. Documentation helps a great deal. The situation she describes is ridiculous and happens to both males and females. This kind of bullying is common these days.

Unless it's a "Right to Work" state or you voluntarily signed a waver upon employment where the Employer can release you without cause. You have the Right to Challenge the employers action and in most cases, documentation is REQUIRED. Especially if this release effects future employment or employment benefits.

She needs to seek Legal support - immediately. There is a time requirement in filing a claim. Each State is different.

then again, we're only hearing (1) side of the story.
