Topic: What is your property/company stance on smoking marijuana in states where it is illegal?

What is your property/company stand on smoking marijuana in states that it’s not legal in yet? I tell my residents that the property is smoke free, and they need to smoke outside. If I smell smoke I will fine them.

We just became legal but regardless our rule has always been we are a no smoking community...if you dont smoke outside we will start termination after we catch you a second time (1st is a written warning).

Arizona- federal law trumps state law- no medical or recreational marijuana. We can serve legal notices and file legal proceedings for eviction.

I am in Indiana. We are a no smoke community and had smokers who smoked inside the house and outside. 3 warnings then I gave them 30 day notice and cancelled lease. Not legal in this state.

It’s legal in Michigan now but our lease follows federal law so it’s still not allowed and I actually will evict someone if they get three lease violations

So here's a question for everyone regarding this subject.....how can you for a fact ascertain that this resident is in fact smoking that you are giving lease violations to? If you dont catch them directly in the act, or have a police report, how can it be legal to evict them on circumstantial evidence if they deny any wrong doing?

Megan Reiss I only violate if I smell it myself. I literally go knock on the door. And I’m in a high rise so it’s pretty easy to detect and offend neighbors. I don’t get why they just don’t vape or eat edibles then all problems would be solved.

I am in California and we are a smoke-free community. Regarding marijuana, I tell them to buy edibles, because they will still be in violation if they smoke.

Smoking is smoking regardless whether it is tobacco or marijuana. If you are a non smoking community it should apply to all smoke. Not sure why everyone differentiates. Alcohol is legal but it doesn’t mean you can drive impaired. Marijuana is legal but the same laws apply in Oregon.

I think people differentiate it because marijuana doesn’t leave the yellow residue on the walls, etc. I can get the marijuana smell out without replacing everything. But, like you said, smoking is smoking. It’s a challenge in a college town.

What people do in the privacy of thier homes as long as it is legal and not in violation of our lease or community policies is none of our business. It can be a slippery slope trying to prove a Resident is smoking pot. I usually send the offending building a letter reminding our Residents that we are drug free and periodically we invite the local Police Dept. to train thier drug snifting K-9's at our property, that does it for awhile. There are no laws yet in Ohio for smoking cigarettes in one's own home. The hallways and outside the building are common areas and resricted from smoking.

As long as a smoke free lease addenda is signed it doesnt matter they cant smoke. They can still ingest THC via edibles if they need it.

Smoking is smoking unless you have in your house /community or rental agreement that states it's non smoking community you can't just address the marijuana smoking. However, for my managers we address a warning letter as a nusiance to the community. As many ppl don't want to accept it, it's legal, in California. You can order it and it's delivered at your doorstep

As I read your replies, I realize what a difficult position we are in. I agree about non-smoking policies. I know people are confused about medical marijuana. However, my biggest concern is that we have been placed in the position of being the police, the judge, the juror, the enforcer...and sadly that's what many of your replies sound like.
Please soften your approach...put out occasional reminders to all residents that it is nonsmoking and say it ways that don't sound like Hitler. The rock and hard place is that they are paying for a 'home' and a certain amount of privacy. No, they can't smoke in nonsmoking buildings/properties. And yes, there will be ramifications. Just work on being polite, kind and customer service oriented. We can say 'no' in less offensive ways. Happy New Year!

How do you police marijuana smoking? Unfortunately it just became legal in Michigan and I manage a multifamily community of 184 units. Everyone blames the next unit when you walk into a building entrance only to smell weed; then sometimes it hard to tell where the stench is coming from. Our policy has been - for any time of smoking, keep it maintained within the confines of your home. Use candles, the ceiling fan, open the window, etc. to balance the smell. It works for some but overall people feel its their right.
