If you own or manage multifamily property, you've probably been pitched a NEMA by a telecom provider. But what is it, really?
NEMA = Non-Exclusive Marketing Agreement
It's a contract that lets a telecom provider market its services to your residents, but doesn't lock you into exclusivity. You can allow multiple providers on-site to compete for your tenants' business.
Why does this matter ❓ 🤔
1️⃣ You stay in control. No provider gets a monopoly.
2️⃣ More options = happier tenants. Residents can choose what works best for them.
3️⃣ You can monetize💰 it. Many providers offer compensation in exchange for access, signage, or unit penetration rights.
Make sure to read the fine print ⤵️
-Does it grant easements or wiring rights?
-Are you giving preferred placement in the leasing office?
-Is there a termination clause or renewal trap?
👨🏫 Telecom Tip: A lot of "consultants" will review these deals, but many don't understand the long-term real estate implications. They might get you a check today, but miss the easement buried in paragraph 12.
You need an attorney who speaks telecom. These deals often look harmless, but they can include permanent rights or limit future negotiations with other providers.
